Welcome to Afro Explorer (the “Service”). These Terms of Service (“Terms”) govern your access to and use of the Afro Explorer website, mobile applications, and related services. By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 16 years old to use Afro Explorer. By using the Service, you confirm that you meet this requirement and have the legal capacity to enter into these Terms.

2. Accounts and Security

Some features require creating an account. You agree to keep your credentials secure and notify us promptly of any unauthorized access. You are responsible for activity that occurs under your account.

3. Acceptable Use

You agree not to:

• Use the Service for unlawful, fraudulent, or harmful purposes
• Upload false, misleading, abusive, or infringing content
• Attempt to interfere with or compromise the Service
• Copy, scrape, or resell the Service or its content without permission

4. User Content and Listings

Business owners may upload listings, images, videos, and descriptions (“User Content”). Ordinary users currently consume content only; reviews and ratings may be introduced later.

You retain ownership of your User Content. By submitting User Content, you grant Afro Explorer a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote that content solely for operating and improving the Service. You are solely responsible for the accuracy, legality, and ownership of your User Content.

5. Marketplace Nature of the Service

Afro Explorer provides discovery and informational tools for attractions, experiences, businesses, and events. We are not a party to agreements entered into between users and third-party businesses unless explicitly stated.

• We do not guarantee the quality, availability, legality, or accuracy of third-party listings.
• We do not guarantee that any third party will fulfill an offer or service.

6. Payments and Refunds

Afro Explorer is free to use within the mobile application. Payments, where applicable, are made through the web platform. Refunds are governed by our Refund Policy: afroexplorer.com/refund-policy . Payments are processed by third-party providers and we do not store full card details.

6.1 Affiliate Commissions

If you participate in the Afro Explorer affiliate program, commissions are calculated based on eligible payments and are paid out in your local currency at the time of payout. Specifically:

• Local Currency Payouts: All commission payments are processed and delivered in the official local currency of your country or region of residence.
• Exchange Rates: If platform transactions occur in different currencies, exchange rates applied will be those set by our payment partners at the time of payout.
• Payment Fees: You acknowledge that payout fees, processing costs, and transfer fees may be applied by our payment partners. These fees will be disclosed before finalizing each payout.
• Payout Details: You are responsible for ensuring your payout details (bank account, mobile money account, or other payment method) are accurate, current, and compliant with applicable local regulations.

6.2 Business Listings and Subscriptions

If you register as a business on Afro Explorer, you agree that your listing application is subject to verification and approval. Publishing and promotional features may require an active paid subscription. Specifically:

• Application Review: We may approve, reject, or request changes to business applications and listing content to maintain platform quality, compliance, and user trust.
• Subscription Requirement: Business profiles may be created at no cost, but publishing products, services, branches, featured placements, and other premium visibility options may require an active subscription tier.
• Business Information Accuracy: You are responsible for keeping your business details, locations, contact information, media, and service descriptions accurate and up to date.
• Compliance and Conduct: You must ensure your listings and operations comply with all applicable laws, regulations, licensing requirements, and these Terms.

7. Availability and Changes

We may modify, suspend, or discontinue parts of the Service at any time. Continued use after updates to these Terms means you accept the revised Terms.

8. Disclaimer

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied.

9. Limitation of Liability

To the maximum extent permitted by law, Afro Explorer shall not be liable for indirect, incidental, consequential, or punitive damages. Our total liability for any claim related to the Service shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.

10. Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, rather than in court, except where prohibited by law. You agree to resolve disputes on an individual basis and waive the right to participate in class actions or representative proceedings.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles.
